The Covid Pandemic visa Subclass 408
In response to the pandemic situation, the Australian government has recently introduced COVID-19 Pandemic event for Subclass 408 (Temporary Activity) visa.
You may be eligible for this visa if you are in Australia and are unable to depart Australia due to COVID pandemic reasons.
You will need to also be either a holder of a temporary visa that has 28 days or less left to expire or your last substantive visa (that is, any main visa apart from bridging visas) expired less than 28 days before.
However, to qualify you would additionally need to have no other visa option available. This condition of having no other visa option can refer to either
- to your eligibility for the visa as to whether you would qualify or not or
may also refer to:
-validity of the application: That is, if you have no option of making a valid application while onshore in Australia. (However, please note that, if you have previously been refused a visa in Australia and you are affected by s48 bar of the Migration legislation, then you CANNOT apply for this COVID-19 visa)
This is understandably a very challenging time for many temporary visa holders in Australia due to the pandemic. The dynamic and changing migration laws makes things all the more complex.
